The Platform is owned, operated, and maintained by Start My Business Inc. ("Company," "we," "us," or "our"). If you do not agree to these Terms, do not access or use the Platform.
We may update these Terms at any time by posting the revised version on this page with a new effective date. Your continued use of the Platform after any changes means you accept the updated Terms. We encourage you to review this page periodically.
FleetCommand Pro is a software-as-a-service (SaaS) fleet management platform that provides tools for dispatch, vehicle tracking, compliance management, driver management, route optimization, and related fleet operations. The Platform is built, maintained, and licensed by Start My Business Inc., a brand management and business buildout company.
FleetCommand Pro is not a trucking company, freight broker, or logistics provider. The Platform is a software tool licensed to businesses ("Licensees") that operate fleets or manage transportation operations.
To use certain features of the Platform, you must create an account. When registering, you agree to:
We reserve the right to suspend or terminate accounts that contain false information or that violate these Terms.
FleetCommand Pro offers subscription-based access. By selecting a plan, you agree to the following:
We may offer free trial periods at our discretion. At the end of a trial, your account will convert to a paid subscription unless you cancel before the trial expires. We will notify you before charging your payment method.
You agree to use the Platform only for lawful purposes and in compliance with all applicable laws. You may not:
All software, code, design, graphics, trademarks, logos, documentation, and content associated with FleetCommand Pro are the exclusive property of Start My Business Inc. This includes all versions, updates, modifications, and derivative works of the Platform.
Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your internal business operations during the term of your subscription. This license does not transfer any ownership rights to you.
You may not copy, modify, distribute, sell, or create derivative works based on the Platform or any of its components without prior written consent from Start My Business Inc.
Start My Business Inc. offers White Label licensing agreements that allow approved Licensees to operate a branded version of FleetCommand Pro under their own company name. White Label Licensees receive:
All White Label versions of the software remain the intellectual property of Start My Business Inc. Licensees do not acquire ownership of the underlying software, technology, or infrastructure. The terms of each White Label arrangement are governed by a separate licensing agreement between the Licensee and Start My Business Inc.
You retain ownership of all data you upload, input, or generate through your use of the Platform ("Your Data"). By using the Platform, you grant Start My Business Inc. a limited license to process, store, and display Your Data solely for the purpose of providing the services described in these Terms.
If you operate under a White Label Licensee, your fleet data may be accessible to that Licensee as part of their management of your account. Review the Licensee's own privacy practices for details on how they handle your information.
We will not sell Your Data to third parties. Upon termination of your account, you may request export of Your Data within 30 days. After that period, we may delete Your Data in accordance with our data retention policies.
Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, store, and share your information. By using the Platform, you acknowledge that you have read and understood the Privacy Policy.
Either party may terminate this agreement as follows:
Upon termination, your right to access and use the Platform ends immediately. Sections of these Terms that by their nature should survive termination (including Intellectual Property, Limitation of Liability, and Indemnification) will remain in effect.
The Platform is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. Start My Business Inc. specifically disclaims all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Platform will be uninterrupted, error-free, or secure at all times. We do not guarantee the accuracy, reliability, or completeness of any data processed through the Platform, including GPS tracking data, route calculations, or compliance reports.
You are responsible for verifying all operational decisions made using information from the Platform. The Platform is a tool to assist fleet management; it is not a substitute for professional judgment, regulatory compliance audits, or legal advice.
To the maximum extent permitted by law, Start My Business Inc., its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform. This includes, without limitation, damages for lost profits, lost revenue, lost data, business interruption, or any other intangible losses.
Our total aggregate liability for any claims arising under these Terms shall not exceed the total amount you paid to us during the twelve (12) months immediately preceding the event giving rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the fullest extent permitted by applicable law.
You agree to indemnify, defend, and hold harmless Start My Business Inc. and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of those courts.
Before filing any formal legal action, both parties agree to attempt to resolve disputes through good-faith negotiation for a period of at least thirty (30) days. To initiate this process, the complaining party must send written notice describing the dispute to the other party.
If the dispute cannot be resolved through negotiation, either party may pursue binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration shall take place in Texas. The arbitrator's decision shall be final and binding.
You agree that any arbitration will be conducted on an individual basis and not as a class action, collective action, or representative proceeding. You waive any right to participate in a class action lawsuit or class-wide arbitration against Start My Business Inc.
We reserve the right to modify, update, or discontinue any feature or aspect of the Platform at any time with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Platform or any part of it.
The Platform may integrate with or link to third-party services, APIs, or websites. We do not control and are not responsible for the content, privacy practices, or availability of those third-party services. Your use of any third-party service is at your own risk and subject to that service's terms and policies.
By creating an account, you consent to receive electronic communications from us, including emails about your account, billing, service updates, and promotional offers. You can opt out of promotional emails at any time, but transactional communications related to your account are required as part of the service.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
These Terms, together with the Privacy Policy and E-Sign Consent, constitute the entire agreement between you and Start My Business Inc. regarding your use of the Platform. These Terms supersede all prior agreements, understandings, and communications (whether written or oral) regarding the subject matter covered here.
